Terms of sale - Artemide LXIII

GENERAL TERMS AND CONDITIONS OF SALE

1. This is a public auction conducted by Artemide Aste S.r.l. Participation and/or the consignment of material is subject to our discretion.
2. The hammer price is subject to a 20% buyer’s premium.
3. All items offered for sale are awarded to the highest bidder by the Auctioneer. To protect buyers, “unlimited bids” will not be accepted.
4. Payment for lots awarded must be made within 7 days of the invoice date. Until full payment is received, items remain the property of the consignor. Failure to pay within the deadline may result in cancellation of the order.
5. Participants must provide the Auctioneer with all necessary identification information before the start of the auction. At the Auctioneer’s discretion, a deposit equal to 25% of the expected bids may be requested; any unused amount will be fully refunded at the end of the auction. All bids must be signed. Bids submitted in paper form (letters and faxes) must bear a handwritten signature to be considered valid. These rules also apply to those participating by mail or electronically. For certain auctions, a "credit limit" may be assigned to a client, representing the maximum total amount they may spend during the auction. Once this limit is reached, the acceptance of further bids from that client is not guaranteed.
6. Bids must refer to the lot numbers in the catalogue. The auction will proceed in catalogue order, although Artemide Aste S.r.l. reserves the right to modify it. Artemide Aste S.r.l. is not responsible for errors in bidding: please check carefully the lot number and the maximum amount you are willing to bid. We will do our best to correctly register bids submitted via email or online platforms, but we cannot guarantee the infallibility of this service.
7. Each lot has a starting price. Lots may be sold at or above the starting price. Bids below the starting price will not be accepted.
8. Artemide Aste S.r.l. reserves the right to withdraw, divide or combine lots, for any reason deemed appropriate.
9. All lots are considered authentic unless otherwise stated, based on the assessments of our experts. Any claims must be made within 7 days of receipt of the lot (postmark will serve as proof). Lots must be returned in the same condition in which they were sent, without opening sealed packaging. Returns will not be accepted without prior consent. Claims submitted more than 30 days after the close of the auction will not be accepted. The return of multiple-lot groupings is not permitted.
10. The attribution and grading of lots reflect the subjective opinion of our experts and do not constitute a guarantee. Grading is also subjective. The terms “Proof,” “Specimen,” or “Prova” refer to the method of striking, not the state of preservation. Descriptive adjectives are not binding and are not part of the official lot description.
11. This is an auction sale, not a direct sale. Bidders waive the right of withdrawal applicable to distance sales. Lots may be viewed prior to the auction. Our experts are available for clarification. Bidders are encouraged to clarify any doubts before participating.
Artemide Aste S.r.l. acts solely as an intermediary between the consignor and the buyer; each sale must therefore be considered as concluded directly between these two parties. Consequently, any obligation relating to the sale (authenticity, provenance, condition, etc.) ultimately lies with the consignor.
In case of any claim for damages or legal action for compensation, the liability of Artemide Aste S.r.l., as an intermediary, is in any case limited to the amount of its commission received on the contested lot.
12. Absentee bids sent by mail, email, or fax are accepted from those unable to participate in person or online. Bids must be expressed in Euro and received before the auction closing date. The highest bid wins the lot. If the highest bid is received by correspondence, the lot will be awarded with a maximum increment in accordance with the bidding steps table. In case of equal bids, the earliest received will prevail. Bids made in the room or online take precedence over absentee bids.
13. Artemide Aste S.r.l. reserves the right to refuse bids from parties deemed unreliable or not acting in good faith. In the case of in-room auctions, anyone disrupting the proper conduct of the auction may be removed.
14. The photographs in the catalogue represent the actual lots. Dimensions and weights are approximate and not grounds for cancellation of purchase.
15. Shipping, insurance, and any applicable taxes are the responsibility of the buyer.
16. Artemide Aste S.r.l. may request payment in advance before shipping. Lots travel at the buyer’s risk and expense. The buyer is responsible for arranging collection and optional insurance.
17. If payment is not received within 30 days of the auction close, Artemide Aste S.r.l. may cancel the sale and reoffer the lot. In such case, the buyer is still liable for the buyer’s premium and any difference between the original and the resale price.
18. Artemide Aste S.r.l. reserves the right to bring forward or postpone the auction date if events arise that may affect the auction's proper conduct.
19. By submitting a bid, the bidder personally guarantees payment, even if acting on behalf of a third party. If the bid is submitted on behalf of a company, the company’s administrator personally guarantees payment. Faxes and letters must be signed.
20. Artemide Aste S.r.l. may offer its own lots in the auction. Consignors may bid on and repurchase their own lots, paying the standard commission and any applicable fees.
21. If Artemide Aste S.r.l., for any reason, is unable to deliver lots to the buyer, the amount paid will be fully refunded. As an intermediary, Artemide Aste S.r.l. cannot be held liable for indirect or consequential damages due to non-delivery.
22. Purchased lots may be retained by Artemide Aste S.r.l. as security for payment of outstanding balances.
23. It is illegal and punishable by law to collude with others to disrupt the proper conduct of the auction in order to acquire lots and later dispute them in a “private auction.”
24. Any dispute arising from the auction is governed by the laws of the Republic of San Marino. The competent court is that of the Republic of San Marino.
25. Participation in the auction implies full acceptance of these terms and conditions.
26. In the event of discrepancies between language versions, the Italian version shall prevail.
