Terms of sale - Artemide 69E


GENERAL TERMS OF SALE
1. This is a public auction conducted by Artemide Aste s.r.l. The possibility of participating in it and / or providing material is subject to our discretion.
2. The hammer price is subject to 20% auction fees.
3. All items for sale are attributed to the highest bidder by the Auction Director. For the protection of buyers, “unlimited offer” type commissions will not be accepted.
4. Payment for the awarded lots must be made within 7 days of issuing the invoice. Until paid in full, the objects remain the property of the consignor. Late payment can be a reason for canceling the order.
5. Auction participants are required to provide the Auction Director with all the information necessary for their recognition before the Auction is held. At the discretion of the Auction Director, participants must deposit an amount equal to 25% of the commissions they will present in advance; the unused amount will be refunded in full at the end of the auction. All offers must be signed. The aforementioned rules also apply to those who participate in the Auction by mail or electronically.
6. All offers must refer to the lots in the catalog according to the respective numbering. The sale will proceed in catalog sequence, but Artemide Aste s.r.l. reserves the right to change this order. Artemide Aste s.r.l. is not responsible for errors made during the award of lots: please make sure that the lot number on which you bid is correct and the maximum amount offered that you are willing to pay. Artemide Aste s.r.l. will do everything possible to correctly register offers received via email or internet portals without however guaranteeing the infallibility of this service.
7. Each lot has a base price. Lots can be sold at the base price or at a higher price. Offers below the base price will not be accepted.
8. Artemide Aste s.r.l., for whatever reason it deems necessary, reserves the right to withdraw, divide or combine the lots for sale.
9. All proposed lots are considered authentic by our experts, unless otherwise specified. Any complaint in this regard must be received no later than 7 days from receipt of the lot. Lots must be returned in the same state in which they were sent and any sealed envelopes or packages must not be opened. No lot must be returned without the consent of Artemide Aste. Under no circumstances can lots be returned after 30 days from the auction closing. In no case the return of multiple lots will be accepted.
10. The attribution and classification of lots is the subjective opinion of our expert classifiers and does not constitute a guarantee of any kind. Likewise, the degree of conservation and quality is the result of a subjective evaluation. In no case is it guaranteed that the expressed degree of conservation must be shared by third parties, whether they are authoritative experts in the sector. The term “Proof”, “Specimen” or “Proof” is used to identify a minting method, not the state of conservation. The adjectives used to describe the lots are also the opinion of the classifiers, do not constitute part of the description of the lot and are not to be understood as a guarantee on the state of conservation.
11. This is not a direct sale, but an auction sale. Participants waive the normal right of withdrawal for distance selling. Auction participants are required to carefully examine all the lots for which they intend to bid. The lots can be viewed in person. Our experts are available for any clarification. Participants are invited to clarify any doubts they have about the status of the lots before the auction takes place.
12. Bids by mail or electronic bids are accepted by those who will not be able to participate live in the auction. All offers must be expressed in Euros. Letters, faxes and emails must be received before the auction closing date or they will not be taken into consideration. The maximum bid will win the lot. If the highest bid is received by post, fax or e-mail, this will win the lot with an increase of no more than 10% compared to the previous bid. With the same bids, the winning bid will be the one received first. Bids submitted during the auction must always exceed bids submitted by post.
13. Artemide Aste s.r.l. reserves the right not to accept offers from subjects who, in their sole discretion, believe they are not acting in "good faith" or are insolvent or irresponsible. Artemide Aste s.r.l. reserves the right to have anyone who disturbs the auction removed from the bidding room (virtual or physical).
14. All the photographs in the catalog are those of the lots presented at auction. The measures and weights are indicative: any inaccuracies do not constitute a valid reason to withdraw from the purchase.
15. Postage, insurance and taxes are the responsibility of the buyer.
16. Artemide Aste s.r.l. reserves the right to request full payment of the lots before their shipment. The lots travel at the buyer's expense. Any risk (for example damage or theft) during transport is borne by the buyer. The customer is required to organize the collection and any insurance of the awarded lots.
17. After 30 days of the auction closing and in the absence of payment for a lot, Artemide Aste s.r.l. has the right to cancel the buyer's purchase. In this case, as well as if the successful bidder of a lot renounces the purchase, Artemide Aste s.r.l. has the right to relist the lot itself. The buyer agrees to still pay the auction fees and the difference between the price of the new award and that of the canceled award.
18. Artemide Aste s.r.l. reserves the right to postpone or anticipate the date of the Auction if it believes that some event may adversely affect the outcome.
19. By submitting a commission, the buyer personally guarantees the payment and cannot claim to act on behalf of third parties; if the commission comes on behalf of a company, the administrator of the same agrees to personally guarantee the payment. Faxes and letters must be signed.
20. Artemide Aste s.r.l. has the right to place its own material for sale. The consignors also have the right to bid on their lots and win them at the Auction. If a consignors wins a lot he has consigned, he will have to pay it at the price reached at the auction plus the expected commission and any taxes and shipping costs.
21. In the event that Artemide Aste s.r.l., for any reason, is unable to send the lots to the buyers, it is required to cancel the sale and reimburse the buyers the price paid including commissions. Artemide Aste s.r.l. cannot be held responsible for damage resulting from non-delivery of the lots.
22. The purchased material may be retained by Artemide Aste s.r.l. to guarantee payment of the amounts owed by the buyer.
23. It is illegal and punishable by law to disturb the regular conduct of the Auction by agreeing and joining together to purchase lots and then disputing them in a "private auction".
24. Any dispute relating to the auction is governed by the law of the Republic of San Marino and the court of the Republic of San Marino will be competent for this dispute.
25. Anyone who participates in this Auction or submits offers accepts these conditions of sale.
26. The conditions of sale are translated into several languages. In the event of a dispute, the Italian version will prevail.
