1. Introduction

These general conditions of sale regulate sales by third parties carried out by the auction house
called “San Martino s.r.l.” (registered office in Appiano Gentile (CO), Via dei Mille 2; VAT number and
CF: 04136430131; email info@astesanmartino.com; pec sanmartinosrl.aste@pec.it) and hereinafter
generalized with the name of “auction house".

2. Registration and participation in the auction, sending offers.

To participate in the auction it is necessary and mandatory to register on the official channels
(auction house website; support portals such as BidInside, DeaMoneta, Sixbid or other active ones;
physically on the day of the auction sale in the case of an auction in room) providing all the
requested data.

By registering and participating in the auction all terms of sale are deemed to have been accepted.

The participant may act on behalf of third parties upon presentation of a written proxy signed by the
delegating party. In this case the awarded material will be invoiced and sent to the delegating party.

The auction house, at its discretion, may request preventive guarantees from the participants
(security deposit, bank guarantee, etc.)

Each participant will be assigned an identification number (tag) which will be used for in-room offers.

Bids can be sent in advance via email to info@astesanmartino.com or through the auxiliary portals
which the auction house may have relied on for the event. If two offers of equal value are received,
the offer received first has priority.

Pre-offers can be sent with a maximum limit and possible final percentage increase.

During remote participation, the auction house is not responsible in any way for any problems
resulting from a possible poor internet connection.

3. Viewing of the Lots

The lots can be viewed a few days before the auction (notification will take place) in the premises
made available by the auction house BY PRIOR APPOINTMENT. No visits will be granted without an
appointment.

In any case, the material will be physically viewable even during the days of the auction at the
premises where the auction sale will take place

4. Award of lots

the value associated with each lot corresponds to the starting price. Bids lower than the starting
price will not be accepted. On the day of the auction sale, the pre-offers received will be analyzed
and, for any sums of commissions, the auction will start from the bracket next to the highest offer
received.

The shots are decided by the auctioneer at his discretion.

The lots can be collected and/or aggregated as needed.

The lot is awarded to the highest bidder.

6. Payments, shipping and costs

Payment for the awarded lot(s) must be made within 5 days of receiving the pro-forma invoice which
will also include any transport and insurance costs.

The collection of the lots is the responsibility of the buyer.

 

NOTE: The auction house can send the lots by charging the transport and insurance costs on the
invoice. The cost of the insurance is defined, on a flat rate, at 1.0% of the total value of the goods,
but never less than €10.00.

 

Shipping costs to EU countries are summarized below:

up to €500.00: €15.00

up to €1000.00: €25.00

up to €3000.00: €30.00

over €3,000.00: to be defined from time to time

 

Shipping costs to non-EU countries will be calculated individually.

 

Taxes and customs duties are the responsibility of the buyer

7. Export

The lots marked with the "*" symbol ARE NOT INTENDED FOR EXPORT.

Export costs, such as customs duties, are the responsibility of the buyer.

The shipment outside the Italian borders of lots over 50 years old is subject to the forwarding of
specific procedures by the Ministry of Cultural Heritage. In general:

• For items with a value of up to €13,500.00, response times are approximately 8 weeks.
• For items with a value exceeding €13,500.00, response times are approximately 12 weeks.

The procedures are managed in the name of the buyer. The auction house is not responsible in any
way for any negative site of the practice.

8. Complaints and returns

All participants are invited to pay maximum attention to the description of the lot and to the
photograph which constitutes an integral part of the description itself

Complaints will only be taken into consideration regarding the authenticity of the lots, the existence
of serious hidden defects or non-conformity between the purchased lots and those described in the
catalogue.

Complaints and returns are not accepted for lots offered in the"sold as is" formula and for lots
marked "to be examined".

Complaints for faults or defects attributable to the buyer's conduct will not be accepted.

9. Copyright and intellectual property

All photographs shown in the catalog are the exclusive property of San Martino S.r.l. auction house.

Any use by third parties without prior written authorization from San Martino s.r.l. is prohibited.

10. Legal Terms

These Conditions of Sale are in any case governed by Italian law according to the Codes that regulateit.
