1. Premessa
Le presenti condizioni generali di vendita regolano le vendite su conferimento terzi effettuate dalla
casa d’aste denominata “San Martino s.r.l.” (sede legale in Appiano Gentile (CO),Via dei Mille 2;
P.IVA e CF: 04136430131; mail info@astesanmartino.com; pec sanmartinosrl.aste@pec.it) e di
seguito generalizzata con il nome di “casa d’aste”.
2. Registrazione e partecipazione all’asta, invio delle offerte.
Per partecipare all’asta è necessario, ed obbligatorio, registrarsi presso i canali ufficiali (sito della
casa d’aste; portali di appoggio come BidInside, DeaMoneta, Sixbid o altri attivi; fisicamente il
giorno della vendita all’incanto in caso di asta in sala) fornendo tutti i dati richiesti.
Con al registrazione e la partecipazione all’asta si intendono accettati tutti i termini di vendita.
Il partecipante può agire per conto terzi previa presentazione di una delega scritta e firmata dal
delegante. In questo caso il materiale aggiudicato sarà fatturato e spedito al delegante.
La casa d’aste, a sua discrezione, può richiedere delle garanzie preventive ai partecipanti (deposito
cauzionale, fideiussione bancaria ecc.)
Ad ogni partecipante verrà assegnato un numero identificativo (cartellino) che sarà utilizzato per le
offerte in sala.
Le offerte possono essere inviate preventivamente via mail all’indirizzo info@astesanmartino.com
o attraverso i portali ausiliari a cui la casa d’aste si sarà eventualmente appoggiata per l’evento. In
caso di ricezione di due offerte di pari valore, ha priorità l’offerta ricevuta per prima.
Possono essere inviate pre-offerte con un massimale ed eventuale incremento percentuale finale.
Durante la partecipazione da remoto, la casa d’aste non è responsabile in alcun modo di eventuali
problemi derivanti da un’eventuale scarsa connessione internet.
3. Visione dei Lotti
I lotti possono essere visionati alcuni giorni prima dell’asta (avverrà comunicazione) presso i locali
messi a disposizione dalla casa d’aste PREVIO APPUNTAMENTO. Non si accorderanno visite senza
appuntamento.
In ogni caso il materiale sarà fisicamente visionabile anche durante giorni della battuta presso i
locali dove si svolgerà la vendita all’incanto
4. Aggiudicazione dei lotti
il valore associato ad ogni lotto corrisponde alla base d’asta. Non verranno accolte offerte inferiori
alla base d’asta. Il giorno della vendita all’incanto si provvederà all’analisi delle pre-offerte ricevute
e, per eventuali somme di commissioni, l’asta inizierà dallo scaglione prossimo alla più alta offerta
ricevuta.
Gli scatti sono decisi dal banditore a sua discrezione.
I lotti possono essere eventualmente ritirati e/o aggregati secondo esigenza.
Il lotto viene aggiudicato al miglior offerente.
5. Commissioni
Le commissioni sono del 20%
6. Pagamenti, spedizione e costi
Il pagamento del/i lotto/i aggiudicato/i dovrà essere effettuato entro 5 giorni dalla ricezione della
fattura pro-forma dove saranno anche conteggiate le eventuali spese di trasporto e assicurazione.
Il ritiro dei lotti è a cura dell’acquirente.
NOTA: La casa d’aste può provvedere all’invio dei lotti addebitando i costi di trasporto e
assicurazione in fattura. Il costo dell’assicurazione è definito, forfettariamente, nella misura
del 1.0% del valore totale della merce, ma mai inferiore ai € 10.00.
Le spese di spedizione nei paesi UE si riassumono di seguito:
fino a € 500,00: € 15,00
fino a € 1000,00: € 25,00
fino a € 3000,00: € 30,00
oltre € 3.000,00: da definire di volta in volta
Le spese di spedizione verso paesi extra UE saranno calcolate singolarmente.
Tasse ed oneri doganali sono a carico dell’acquirente
Il pagamento dei lotti può avvenire:

7. Esportazione
Il lotti contrassegnati dal simbolo “ * ” NON SONO DESTINATI ALL’ESPORTAZIONE.
Le spese di esportazione, come le spese doganali sono a carico dell’acquirente.
La spedizione fuori dai confini italiani dei lotti con più di 50 anni è subordinata all’inoltro del
Ministero dei Beni Culturali di specifiche pratiche. In linea di massima:
- Per gli oggetti con valore fino a € 13.500,00 i tempi di risposta sono indicativamente di
circa 8 settimane.
- Per gli oggetti con valore superiore ai € 13.500,00 i tempi di risposta sono
indicativamente di circa 12 settimane.
Le pratiche sono gestite a nome dell’acquirente. La casa d’aste non è responsabile in alcun modo
dell’eventuale sito negativo della pratica.
8. Reclami e resi
Si invitano tutti i partecipanti a prestare la massima attenzione alla descrizione del lotto ed alla
fotografia che costituisce parte integrante della descrizione stessa
Verranno presi in considerazione reclami solo in merito all’autenticità dei lotti, sull’esistenza di
gravi difetti occulti o sulla non conformità fra i lotti acquistati e quelli descritti nel catalogo.
Non si accettano reclami e resi per i lotti offerti nella formula “visto e piaciuto” (Sold as is) e per i
lotti contraddistinti dalla dicitura “da esaminare”.
Non saranno accettati reclami per vizi o difetti imputabili alla condotta dell’acquirente.
9. Copyright e proprietà intellettuale
Tutte le fotografie riportate sul catalogo sono di proprietà esclusiva della San Martino S.r.l. casa
d’aste. Ne viene vietato ogni uso da parte di terzi senza preventiva autorizzazione scritta della San
Martino s.r.l.
10. Termini di Legge
Le presenti Condizioni di Vendita sono comunque regolate dalla Legge Italiana secondo i Codici che
la regolamentano.
11. Foro Competente
Per ogni controversia, il Foro competente è quello di Como

1. Introduction
These general conditions of sale regulate sales by third parties carried out by the auction house

generalized with the name of “auction house".
2. Registration and participation in the auction, sending offers.
To participate in the auction it is necessary and mandatory to register on the official channels
(auction house website; support portals such as BidInside, DeaMoneta, Sixbid or other active ones;
physically on the day of the auction sale in the case of an auction in room) providing all the
requested data.
By registering and participating in the auction all terms of sale are deemed to have been accepted.
The participant may act on behalf of third parties upon presentation of a written proxy signed by the
delegating party. In this case the awarded material will be invoiced and sent to the delegating party.
The auction house, at its discretion, may request preventive guarantees from the participants

Each participant will be assigned an identification number (tag) which will be used for in-room offers.
Bids can be sent in advance via email to info@astesanmartino.com or through the auxiliary portals
which the auction house may have relied on for the event. If two offers of equal value are received,
the offer received first has priority.
Pre-offers can be sent with a maximum limit and possible final percentage increase.
During remote participation, the auction house is not responsible in any way for any problems

3. Viewing of the Lots
The lots can be viewed a few days before the auction (notification will take place) in the premises

4. Award of lots
the value associated with each lot corresponds to the starting price. Bids lower than the starting

7. Export
The lots marked with the "*" symbol ARE NOT INTENDED FOR EXPORT.

of serious hidden defects or non-conformity between the purchased lots and those described in the
catalogue.
Complaints and returns are not accepted for lots offered in the"sold as is" formula and for lots
marked "to be examined".
Complaints for faults or defects attributable to the buyer's conduct will not be accepted.
9. Copyright and intellectual property
All photographs shown in the catalog are the exclusive property of San Martino S.r.l. auction house.
Any use by third parties without prior written authorization from San Martino s.r.l. is prohibited.
10. Legal Terms
